Chesterfield dad's 'nightmare' with 'deliberate' overflowing of bath from flat above

Kyle Mitchell, 29, has been without a light in his bathroom for two-and-a-half years and faces constant issues with mould on the ceiling.
He claims it is caused by the tenant of a flat directly above his – and says he is ‘getting nowhere’ after repeated complaints to Chesterfield Borough Council.

Hide AdThe authority said it takes all complaints seriously and is working with Mr Mitchell to find a solution.
Mr Mitchell, who suffers with anxiety and depression, said: “It has been going on for two-and-a-half years now. I have got a bathroom ceiling leak, no light and mould growing.
“The council investigated and confirmed that the tenant above was doing it deliberately.
“He was overflowing his bath and splashing water about. It has been like living a nightmare and nothing ever gets done about it. I have also had problems with loud music from the flat above.

Hide Ad“My five-year-old son comes to visit at weekends and he has to have a shower in the dark. It can’t be right.”
Councillor Chris Ludlow, Chesterfield Borough Council’s cabinet member for housing, said: “We take all complaints from our tenants seriously. All concerns relating to tenants are investigated by our dedicated neighbourhoods team and we will try to resolve complaints as quickly as possible.
“In this instance we are working with Mr Mitchell to try and resolve this situation, as we would for any other council tenant.”
